Sidemoney reserves the right to refuse service and/or prohibit or terminate access to the Services, in whole or in part, for any or no reason, at any time in its sole discretion, with or without notice to you. Further, your breach of these Terms and Conditions may jeopardize your continued use of the Services and may result in the cancellation of your orders, among other consequences.
THE USE OF ANY ROBOT, SPIDER, OR OTHER AUTOMATIC DEVICE OR SOFTWARE IN CONNECTION WITH THE SERVICES IS STRICTLY PROHIBITED. Your Account
If you create an account on the Services, you are responsible for maintaining the confidentiality of your account information and password, and for protecting and restricting access to such information. You understand and agree that you are responsible for all activities that occur using your account or password, whether or not you authorized such activity. Sidemoney reserves the right, in its sole discretion and without notice to you, to terminate your account and/or to restrict access to all or part of the Services for any reason, including, without limitation, for extended periods of inactivity.
Product Descriptions
Sidemoney endeavors to be accurate when describing and displaying products on the Services. However, items may occasionally be mispriced, described inaccurately, or unavailable. Certain weights, measures, and similar descriptions are approximate and are provided for convenience purposes only, and fit and sizing may vary between brands, products, and even the same or similar products. The particular technical specifications and settings of your device and its display could affect the accuracy of its display of the colors of products offered on the Services. As a result, Sidemoney does not and cannot guarantee the accuracy, reliability, currency, or completeness of the information on the Services, including prices, product images, descriptions, specifications, and indications of availability. Sidemoney reserves the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Pricing and Payment
The price for all goods will be as quoted on the Services. The prices displayed on the Services are quoted in U.S. dollars. Prices and availability information are subject to change without notice. Prices do not include sales tax, where applicable, or delivery costs, both of which you agree to pay upon ordering.
Order Acceptance
All orders placed by you are subject to acceptance by Sidemoney and all items are subject to availability.
Acknowledgement of your order means that Sidemoney has received your order request; it does not mean that your order has been accepted or shipped, or that the price or availability of an item has been confirmed. Sidemoney may in its discretion require additional verification or information before accepting any order.
Sidemoney reserves the right, without prior notice and in its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include, but are not limited to: invalid, incomplete, improper, or missing payment or shipping information; limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; use of any robot, spider, or other automatic device, software, process, or application to place or take preparatory steps to place one or more orders; violation of these Terms and Conditions; or actual or suspected fraud or abuse.
Sidemoney will verify the availability and price of an item before it is shipped. If an item’s correct price is lower than the stated price, Sidemoney will charge the lower amount and ship you the item. If an item’s correct price is higher than the stated price, if the item is no longer available, or if Sidemoney determines that there were inaccuracies in the product information, Sidemoney may cancel your order and notify you of such cancellation via email.
Limited Release — Purchase Limitation
In an effort to allow fairness for all customers, limited and/or special release products will be restricted to one (1) unit per customer. Multiple orders submitted under the same address will be canceled. Abusive behavior will not be tolerated. Should this pattern continue, your account may be subject to review and possible suspension by our team. Please feel free to reach out to our Customer Service team if you feel your order was canceled in error.
Risk of Loss
All purchases through the Services are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon Sidemoney’s delivery of such items to the shipping carrier. Except as expressly set forth in these Terms and Conditions, you are responsible for filing any claims with the applicable carrier for damaged and/or lost shipments.
Shipping and Returns/Exchanges
Shipping. Once an order is placed it cannot be canceled. For domestic orders, please allow at least 3–5 business days for order processing and verification. Sidemoney will only ship to the address provided at checkout. We are unable to combine shipping on multiple orders.
Due to our fraud protection policy, any orders with different shipping and billing addresses may not be processed.
Lost or Stolen Packages. Sidemoney is not responsible for any lost or stolen shipments. If your package does not arrive, please contact hello@sidemoney.co to initiate a carrier claim.
Return/Exchange Policy. Sidemoney offers customers the option to return certain products within 30 days of purchase. Certain products are non-returnable, including but not limited to final sale items. “Final Sale Items” include sale items, hats, underwear, socks, swimwear, gloves, collaborative releases, and other items listed as not returnable. IN ADDITION, IF WE REASONABLY DETERMINE THAT A PURCHASED PRODUCT THAT MIGHT OTHERWISE BE ELIGIBLE FOR RETURN WAS ORDERED THROUGH THE USE OF A ROBOT OR OTHER AUTOMATIC DEVICE OR SOFTWARE, WE RESERVE THE RIGHT, IN OUR SOLE AND ABSOLUTE DISCRETION, TO REFUSE ANY SUCH RETURN, TO REFUSE TO OFFER ANY REFUND, AND/OR TO CHARGE A RESTOCKING FEE.
To initiate a return, please contact hello@sidemoney.co. The packaging must be intact and the product must be unused with all tags attached. Sidemoney reserves the right to charge a restocking fee for returns in violation of these Terms and Conditions, including items returned damaged or missing packaging or documentation.
For returns, customers will be granted an online credit equal to the amount paid for the item(s) returned, minus any applicable restocking fee. Original shipping costs will not be reimbursed.
License for Personal Use

Restrictions on Use

Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Sidemoney, its partners, its licensors, and its and their affiliates, members, officers, directors, managers, employees, consultants, agents, suppliers, contractors, successors, and assignees harmless from and against any and all damages, liabilities, actions, causes of action, suits, claims, demands, losses, costs, and expenses (including without limitation reasonable attorneys’ fees and court costs) arising from or in connection with (a) your use of the Services or any Materials; (b) your violation of these Terms and Conditions; (c) any submission provided by you to Sidemoney; or (d) your violation of any rights of any third party.

Sidemoney has no responsibility for the content thereof and shall not be responsible or liable for any damages or injury arising from your access to or use of that content. Submissions
Any remarks, graphics, or other information provided by you by any means, including through the Services, email, or a contact form, is and will be non-confidential and non-proprietary, except to the extent that such contains or constitutes personal information, which is subject to the guidelines established in our Privacy Statement.
Arbitration; Class Action Waiver; Jury Trial Waiver; Governing Law
Equitable Relief. You acknowledge and agree that your actual or threatened breach of these Terms and Conditions would give rise to irreparable harm to Sidemoney for which monetary damages would not constitute an adequate remedy and will entitle Sidemoney to immediate injunctive and other equitable relief without any requirement to post bond.
Governing Law; Venue. These Terms and Conditions are governed and interpreted pursuant to the laws of the Commonwealth of Pennsylvania, United States of America, notwithstanding any principles of conflicts of law. If you take legal action relating to these Terms and Conditions that is not subject to arbitration as provided below, you agree to file such action only in the state and federal courts located in Philadelphia County, Pennsylvania, and waive any objection you may have to the venue or forum.
Pre-Arbitration Dispute Resolution. Any controversy or claim between you and Sidemoney arising out of or relating to these Terms and Conditions, or breach thereof, including disputes with respect to whether the subject matter of any controversy or claim is within the scope of these Terms and Conditions (a “Dispute”), will be resolved in accordance with the following process. One party must first send a written notice of the Dispute to the other party by email with a delivery receipt requested (“Notice”). Sidemoney’s email address for Notice is hello@sidemoney.co. The Notice must describe the nature and basis of the Dispute and set forth the specific relief sought (the “Demand”). The parties shall first meet and confer by such method as the parties may mutually agree, to attempt to resolve the Dispute. The parties shall work together in good faith to attempt to resolve the Dispute directly for thirty (30) days after the Notice is received, or such further period as the parties may mutually agree. In the event that the Dispute is not resolved by the end of such thirty (30) day (or longer) period, then either party may commence arbitration as further described below.
Arbitration. If the parties are unable to resolve a Dispute through the good faith negotiation procedure set forth above, then you and Sidemoney agree that such Dispute will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate Disputes includes all claims arising out of or in any way related to these Terms and Conditions, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE TERMS AND CONDITIONS, YOU AND SIDEMONEY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. Notwithstanding the foregoing, nothing in these Terms and Conditions will be deemed to waive, preclude, or otherwise limit the right of either party to seek injunctive relief in aid of arbitration from a court of competent jurisdiction in Philadelphia County, Pennsylvania, or to file suit on an individual basis in small claims court for applicable claims.
Arbitration Process. Unless otherwise agreed upon by the parties in writing, the arbitration will be conducted in Philadelphia, Pennsylvania, or by video conference (at the claimant’s election), and will be governed by National Arbitration and Mediation’s (“NAM”) Comprehensive Dispute Resolution Rules and Procedures (the “NAM Rules”), as may be modified by these Terms and Conditions. The arbitration will have one (1) neutral arbitrator if the amount in controversy is less than one million dollars ($1,000,000) or otherwise before a panel of three (3) neutral arbitrators. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. In the event that any Dispute is held not to be arbitrable in accordance with this section, each party consents to the exclusive jurisdiction of the state or federal courts located in Philadelphia County, Pennsylvania.
No Class Actions. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SIDEMONEY AGREE THAT ANY CLAIMS BROUGHT BY YOU AGAINST SIDEMONEY MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND MAY NOT AWARD CLASS-WIDE RELIEF. Assignment
You may not assign or otherwise transfer these Terms and Conditions or any rights or obligations hereunder, in whole or in part, and any such assignment in violation of this agreement shall be null and void. The failure of Sidemoney to exercise or enforce any right or provision set forth herein shall not constitute a waiver of such right or provision. These Terms and Conditions set forth the entire understanding between you and Sidemoney with respect to the subject matter hereof and supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written, between you and Sidemoney with respect to such subject matter.
Amendments and Modifications to the Services
Sidemoney reserves the right to make changes to the information, data, and Materials provided on the Services at any time without notice. Sidemoney also reserves the right to modify or discontinue some or all of the Services, or any Materials contained or accessible thereon, at any time without prior notice. Sidemoney shall in no way be held liable for any consequence which results from Sidemoney’s decision to modify or discontinue providing the Services or any content or functionality thereof.
Miscellaneous
You guarantee that (i) you are not located in a country that is subject to U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Sidemoney expressly reserves the right to monitor any and all use of the Services. Sidemoney also reserves the right to investigate and take legal action against any illegal and/or unauthorized use of the Services and/or Materials. Sidemoney’s decision not to pursue legal action for any violation of this agreement shall not be construed as a waiver of any provision of this agreement or any of Sidemoney’s legal rights.
These Terms and Conditions constitute the entire agreement between you and Sidemoney with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, understandings, and representations, whether written, oral, or otherwise.
Annex A: Mobile Message Service Terms and Conditions
Your use of Sidemoney’s SMS/text messaging service (the “SMS Service”) constitutes your agreement to these terms and conditions (these “SMS Terms”). We may modify or cancel the SMS Service or any of its features at any time, without notice. To the extent permitted by applicable law, we may also modify these SMS Terms at any time and your continued use of the SMS Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to participate in the SMS Service, you agree to receive recurring SMS/text messages from and on behalf of Sidemoney through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. From time to time, we may send you promotional messages to inform you about product launches, promotions, markdowns, partnership announcements, and other marketing offers.
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Sidemoney. Your participation in this program is completely voluntary.
We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.
You may opt out of the SMS Service at any time by texting STOP to the number from which you received messages. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. For SMS Service support or assistance, text HELP to the same number or email hello@sidemoney.co.
We may change any short code or telephone number we use to operate the SMS Service at any time and will notify you of these changes. The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS Service.
